Kingsbury Square Association Board of Directors Meeting Minutes

August Monthly Meeting

Old Business

Security at Westminster Gate-discussion revolved around the continuing abuse of an open gate at late hours so that outsiders can enter to visit a resident's teenage daughters. The discussion centered on if or when to change the lock and limit the number of keys available to residents and board members or to board members only. The Board decided (motion made, seconded, accepted) to speak with the involved resident one more time (previous talks have been held) and that if another infraction of keeping the gate locked does occur, the lock will be changed and keys will be available to the Board President and Secretary only. Rater will follow up on this matter.

Architectural Committee

Progress on North Fence/Westminster-Board discussed and decided (motion made, seconded, accepted) to continue to pursue the philosophy that the Board and its Architectural Committee are to facilitate discussion and meetings between the involved residents and the Metro representatives. The Board should not involve itself in acting as a negotiator between the two entities. Since the fence issue needs a speedy resolution, if Metro is now willing to contribute money that should happen as quickly as possible or if not, the residents along that boundary should engage a contractor and complete the fence reconstruction. It was reported to the Board that there are several residents who are anxious to engage a contractor now and begin reconstruction this fall.

Follow-up on Maintenance Walk Notices-The Board discussed the process for follow through on the notices sent to residents re: maintenance of their property. A motion was made, seconded and accepted that there be 30 days between the issuance of the first notice and the second notice IF the repair/maintenance had not been either completed or proof of progress made. Therefore, the persons notified in July should be followed up and a second notice sent to those who have not completed or progressed. The second notice should quote that portion of the By-laws, Restrictions, Covenants re: maintenance and the KS Board's authority to authorize such maintenance by a contractor at the property owner's cost.

Annual Meeting-The date for the meeting will be Monday, September 20 at 6 PM. The third Monday of September is cited in the KS By-Laws & Regulations as the date of the annual meeting. An announcement flier will be sent to each resident with the date, time and location of the meeting. A slate of candidates for Board officers will be attached with a write-in candidate option. The attached proxy ballot is to be used only by those unable to attend the meeting and mailed to the Association post office box. Brancich will follow-up. The location will be determined immediately after this meeting to assure space availability. Rater will follow-up. Treasurer Report-All large overdue resident fees have been paid including the lien property owner. New property owners are not being reported to the Board by the title companies resulting in new residents not receiving KS By-laws. Also, the Board does not having information on the resident owners to both welcome them and to enter them into the treasurer's database.

A motion was made, seconded and accepted that all title companies be reminded of their responsibility to notify the new property owner of the KS Association annual fees and also notify the KS Board of the new owner's name and address. Included in the reminder would be the option for the title company to charge the KS Association $25 for a copy of the KS By-laws, Restrictions and Declared Covenants to be given to the new owner at the time of closing.

New Business

Architectural/Maintenance Issues-At the Annual Meeting the section of the By-laws, Restrictions and Declared Covenants will be cited re: political signs and real estate sale signs. This will be an informational item to remind residents of the need to seek Board approval for posting of signs.

New repair issues have arisen since the May Walk-through of the Architectural/Maintenance Committee. This strongly suggests that a continuing vigilance by committee members and other Board members is needed with notices sent sooner rather than later.

A request was of the Board to approve the construction of a new retaining wall in front of 5752-5758 Kingsbury. Motion made, seconded and accepted for replacement of the retaining wall.

Next Meeting September 12, 10 AM at Brancich Residence for the purpose of finalizing the Annual Meeting Agenda.
