How is my classification determined?
By the Potential-to-Emit (PTE).
- Part 70 (Major) Sources are:
- Facilities where PTE is greater than 100 tons per year, or:
- Facilities where PTE is greater than 10 tons per year of any HAP, or 25 tons per year of any combination of HAPs, or:
- Facilities subject to any NSPS, NESHAP, or MACT standard.
- Intermediate (FESOP, voluntary, synthetic minor) Sources are:
- Eligible sources producing actual emissions
below the major source thresholds and willing to take enforceable permit limits to keep the emissions
below the major source threshold. The source can not be one of the specifically listed sources of the Clean Air Act.
- Basic Sources are:
- Facilities where PTE is greater than de minimis levels, but less than major source thresholds.

- All companies listed in the Missouri Operating Permit Registry for The City of St. Louis, under County Code 4280.

When is my application deadline?
- Basic Sources: Any installation that becomes subject to 10 CSR 10-6.065 shall
file a complete application no later than 30 days after commencement of operations.
- Intermediate Sources: Any installation that becomes subject to 10 CSR-6.065
shall file a complete application no later than 30 days after commencement of operations.
- Part 70 Sources: Any installation that becomes subject to 10 CSR-6.065 shall
file a complete application at the commencement of operations.

- Basic Sources: File at least six (6) months before the date of permit expiration.
- Intermediate Sources: File at least six (6) months before the date of permit expiration.
- Part 70 Sources: File at least six (6) months before the date of permit expiration,
starting as early as 18 months from the date of expiration.

Who has the Authority?

A Title V permit is an operating permit required under Title V of the Clean Air Act. The Title V
permit brings together the Federal, State, and City Air Pollution Control requirements for the entire
facility into one permit. EPA has given the Missouri Department of Natural Resources authority to
implement the Title V program. The rules are promulgated in the Missouri Air Conservation Law, Section 643.

The City of St. Louis Air Pollution Control Division will process the City of St. Louis Title V permit
applications and prepare draft permits following the guidelines specified in the Missouri Administrative Code.
The final Title V permits will be issued by the Missouri Department of Natural Resources.
In addition to state and federal permit review, the draft permit will be
available for public comment before the final permit is issued.

Some major sources may be eligible to obtain a Intermediate Operating Permit instead of the Title
V permit. The Intermediate Operating Permit is a Federally enforceable State permit that contains
emission limits to keep the facility from becoming a Title V facility.

- Basic and Intermediate installations get one copy back upon Completeness Determination.
- Part 70 Installations will get letter upon Completeness Determination.
