In accordance with Title I of the Housing & Community Development Act of 1974, as amended, and pursuant to Title 24 of the Code of Federal Regulations (CFR Part 58.44) the City of St. Louis, as applicant for funds from the U.S. Department of Housing and Urban Development (HUD), hereby declares a Notice of Finding of No Significant Effect on the Environment and gives notice to the public of Intent to Request Release of Funds for the 2001 City of St. Louis Action Plan, which includes the Community Development Block Grant (CDBG), totaling $29,500,000, Home Investment Partnership (HOME),totaling $5,500,000, Emergency Shelter Grant (ESG), totaling $1,000,000, and Housing Opportunities for Persons with AIDS (HOPWA) Funds, totaling $1,000,000. This is a combined notice to meet two procedural requirements found at 24 CFR Part 58.44. Respondents should specify which of the two notices below they wish to address.

Where applicable, a review of environmental impact was conducted for the above-referenced programs. An Environmental Review Record (ERR) was made by the City of St. Louis for this project. The ERR includes a determination of the type of environmental assessment required per 24 CFR Part 58. The ERR is on file at the Planning & Urban Design Agency (PDA) and is available for public examination upon request. Of the above-referenced programs, those engaged in housing rehabilitation and repair activities are administered through and reviewed by the Community Development Agency (CDA). CDA will provide to the ERR, when applicable, proof of compliance with applicable Lead-Based Paint regulatory requirements. No further environmental review is to be undertaken prior to requesting the release of Federal funding. All interested individuals who disagree with this decision are invited to submit written comments for consideration by the City to the address below. These comments should be received by the City on or before 12/18/00. Comments will be considered by the City and the City will not request release of Federal funding or take any administrative action prior to 12/19/00.
NOTICE OF PUBLIC INTENT TO REQUEST RELEASE OF FUNDS: On or about 12/19/00, the City of St. Louis will submit a request to HUD to release Federal funds under the Act for the above-referenced programs. An ERR of the above-listed projects have been made by the City of St. Louis. The ERR is on file at the address below and is available for public examination. The City is certifying to HUD that St. Louis and Clarence Harmon Jr., in his official capacity as Mayor, consent to accept the jurisdiction of the Federal courts if an action is brought to enforce responsibilities in relation to environmental reviews, decision making, and action, and that the responsibilities have been satisfied. The legal effect of the Certification is that upon its approval, St. Louis may use the CDBG, HOME, ESG and HOPWA funds, and HUD will have satisfied its responsibilities under the National Environmental Policy Act. HUD will accept an objection to its approval of the release of funds and acceptance of the Certification only if it is on one of the following bases: a) That the Certification was not in fact executed by the chief executive officer or other officer or applicant approved by HUD; or b) That the applicant's environmental review for the project indicates omission of a required decision, finding, or step applicable to the project in the environmental review process. Objections must be prepared and submitted in accordance with the required procedure (24 CFR Part 58.73) and may be addressed to HUD at 1222 Spruce Street. Objections to the Release of Funds on bases other than those stated above will not be considered by HUD.
